Policies

These Policies explain how Ultra Cornhole (Vorticy, Inc.) handles shipping, returns, refunds, custom work, cancellations, and pricing. Purchases are also governed by our Terms and Conditions. If this page and the Terms ever disagree, the Terms control.

International Policies

Canada is currently our only international destination. Only bags, apparel, and small accessories are eligible. We do not ship boards internationally.

Due to shipping and duties costs, all international sales are final. We do not accept exchanges or returns on international orders. We may cancel an international order if shipping or customs complications look likely. This International Policy overrides other return and refund policies.

We cannot provide customer service for items delivered in the United States and then taken into another country, even if the item has a defect.

Shipping Policy

Please visit our shipping page for carriers, transit times, free-shipping promotions, board vs. bag shipping, and San Diego board pickup. Processing times vary by product. We do not guarantee delivery dates. If you have the order number, we have the order and are working on it.

Returns Policy

If the product is defective, use our contact form or reply to your order confirmation. Include your order number. We will email return instructions. Bag manufacturing defects must be reported within 45 days of delivery. Cosmetic issues on bags must be reported within 7 days of delivery. Full warranty terms are in the Terms and Conditions.

Unused stock items in new, resalable condition may be returned within 30 days of delivery. You pay return shipping to our San Diego facility. There is a 15% restocking fee.

New condition means unthrown and not broken in: no play wear, dirt, marker, odor, pet hair, washing, or unapproved treatment. Thrown or broken-in bags are not new condition.

No returns on custom orders, international orders, or items outside the windows above (unless a covered manufacturing defect).

Refunds Policy

If you purchased by accident and the order has not shipped (stock) or has not entered manufacture (custom), see Order Cancellation Policy below.

Approved change-of-mind returns: after we inspect the item, we refund the product price minus the 15% restocking fee. Original outbound shipping is not refunded unless we shipped the wrong item or the item is defective. Refunds go to the original payment method.

There are no refunds for customization, such as logos, names, photos, or custom colors. A league changing its rules, dropping a stamp year, or shutting down is not a product defect and is not a refund reason after the return window. See “Stamps and League Play” below and the Terms and Conditions.

Custom Orders

We only print and manufacture orders that have been approved. Once you have approved your custom boards or full custom bags, we cannot make additional changes. All custom orders are final, except for a manufacturing defect covered by warranty.

Order Cancellation Policy

Customers may cancel an order prior to shipment of stock items and prior to manufacture of custom orders. Cancellations incur a 5% cancellation fee. Reply to your order confirmation email. We will follow up during business hours. If you cannot find the confirmation email, use our contact form.

If we cancel an order for our own reasons (other than a reseller, raffler, or other policy violation), we refund what you paid for that canceled item.

Reseller and Raffler Order Cancellation Policy

We may cancel any order from a customer who has offered bags for sale higher than the purchase price (resellers) or has raffled bags (rafflers). Canceled orders incur a 5% cancellation fee. The current limit is two sets of four bags per color per household unless a product page says otherwise.

Pricing Policy

Price of our products is subject to change without notice. Price adjustments can occur frequently based on supply and demand. Customers who purchase with the intent to resell drive prices higher. Purchasing from an uncertified reseller is highly discouraged. Warranties are not transferable, so it is better to buy directly from our website. We often put high-demand products on sale because we focus capacity on that item. That is the time to purchase. A later price drop is not grounds for a partial refund.

Stamps and League Play

Some bags and boards carry ACL or other league stamps. Those marks mean the item met that organization’s published standards at the time we manufactured and stamped it. Ultra Cornhole does not operate the American Cornhole League or any other sanctioning body. We do not control whether a league keeps operating, how long a stamp year stays legal for sanctioned play, or whether another organization accepts the same stamp.

Bags are sold as regulation-spec cornhole bags. We do not warrant that a stamped product will remain eligible for any particular event or season. A league shutdown, rule change, or expired stamp year is not a manufacturing defect and is not a refund reason after the return window above. Stamped bags can still be used for backyard play and for events that do not require that stamp. Full language is in the Terms and Conditions.

Warranty Summary

Bags: 45 days from the date received for stitching failures and manufacturing defects. Cosmetic defects must be reported within 7 days of receipt. Boiling, overheating, or any break-in method other than our published process voids the bag warranty. Snags, fiber pull-outs, and play wear are not covered. Warranties are not transferable. Privacy Policy

This privacy notice for Vorticy, Inc. (doing business as Ultra Cornhole) (“Ultra Cornhole,” “we,” “us,” or “our”) describes how and why we collect, store, use, and/or share (“process”) your information when you use our services (“Services”), such as when you:

  • Visit our website at ultracornhole.com, or any website of ours that links to this privacy notice
  • Engage with us in other related ways, including any sales, marketing, or events
  • Contact us by text. By texting us, you agree to receive support/sales texts. Message and data rates may apply. Frequency varies. Reply STOP to opt out.

1. What information do we collect?

In short: we collect personal information you give us, plus limited technical data collected automatically.

We collect information you provide when you register, order, contact us, or join a list. That may include:

  • name
  • phone number
  • email address
  • mailing and billing addresses
  • username, password, and contact preferences

Sensitive information. We do not process sensitive information.

Payment data. Payment card details are handled by PayPal and other processors shown at checkout. See PayPal’s privacy notice.

Information you give us must be true, complete, and accurate. Tell us if it changes.

Information collected automatically. When you visit the Site we collect IP address, browser and device data, operating system, language, referring URL, and general location. We use this to run, secure, and understand the Site. We also use cookies and similar tools. Details: Cookie Notice.

  • Log and usage data: pages viewed, timestamps, searches, feature use, and error reports.
  • Device data: IP or proxy, device IDs, browser, hardware, carrier, and system settings.
  • Location data: approximate location from IP. You can limit this in your device settings; some site features may not work if you do.

2. How do we process your information?

In short: to provide and improve the Services, communicate with you, prevent fraud, and comply with law. We may also process information for other purposes with your consent.

  • Accounts: create, log in, and keep your account working.
  • Support: answer questions and fix order issues.
  • Admin messages: orders, policy changes, and similar notices.
  • Orders: payments, shipping, returns, and exchanges.
  • Marketing: only in line with your preferences. Unsubscribe anytime.
  • Safety: when needed to protect someone’s vital interests.

3. Legal bases

In short: we process information when we have a valid reason under applicable law.

If you are in the EU or UK: we may rely on consent, performance of a contract, legitimate interests (for example sending offers about our products when those interests do not override your rights), legal obligations, and vital interests.

If you are in Canada: we may rely on express or implied consent. You can withdraw consent at any time. Law also allows processing without consent in limited cases such as fraud prevention, legal process, and other exceptions under Canadian law.

4. When and with whom we share information

In short: service providers who help us run the business, and a buyer if the company is sold.

We may share information with vendors under contract (payment, shipping, hosting, email, analytics) and in connection with a merger, sale of assets, financing, or acquisition. We may also disclose information when required by law.

5. Cookies and tracking

In short: we use cookies and similar tools. See our Cookie Notice.

Cookies are small files stored by your browser. We use them to keep you logged in, remember a cart or discount, and understand return visits. We do not put passwords or payment numbers in cookies. You can block cookies in your browser; some shop features may stop working. Interest-based ad opt-out: aboutads.info/choices.

6. How long we keep information

In short: as long as needed for the purposes in this notice, or longer if the law requires (tax, accounting, legal claims).

Account-related information is generally kept while you have an account. When we no longer need personal information, we delete or anonymize it, or isolate backup copies until deletion is possible.

7. How we keep information safe

In short: we use reasonable technical and organizational measures. No method of internet transmission or storage is 100% secure. Use the Site on a secure connection.

8. Your privacy rights

In short: in some regions (EEA, UK, Canada, and California) you have rights to access, correct, delete, or limit use of your information.

Send requests through the contact form. We will handle them under applicable law. You may need to verify your identity.

EEA/UK complaints: EU supervisory authorities. Switzerland: EDÖB.

Withdraw consent. If we rely on consent, you can withdraw it at any time. That does not undo processing already done.

Marketing. Unsubscribe using the link in our emails or by contacting us. We may still send order and account messages.

Account. Log in to update your account, or ask us to close it. We may keep limited records for fraud prevention, disputes, and legal requirements.

9. Do-Not-Track

Browsers may send a DNT signal. There is no common standard for honoring it, so we do not respond to DNT signals at this time. If a standard we must follow is adopted, we will update this notice.

10. California privacy rights

In short: California residents have additional rights under Shine the Light and the CCPA/CPRA.

Once a year, free of charge, you may request the categories of personal information we disclosed to third parties for direct marketing in the prior calendar year, and the names of those parties. Send a written request using the contact details below.

If you are under 18, live in California, and have an account, you may ask us to remove content you posted publicly. We will stop public display; copies may remain in backups.

We keep collected categories as needed to provide the Services, generally while you have an account. We may also collect information when you contact support, join a survey or contest, or receive a delivery.

We may disclose personal information to service providers under written contracts. That is not a “sale.” We do not sell or share personal information as those terms are used in the CCPA.

California residents may request to know, delete, or correct personal information, and will not be discriminated against for exercising those rights. Use an authorized agent only if they prove they are authorized to act for you. We will verify requests before acting.

11. Updates to this notice

We may update this notice. The “Last updated” date at the top of this page will change. Material changes may also be posted on the Site or sent by email.
